Pathwaize Inc, a Delaware corporation doing business as Pathwaize (“Pathwaize,” “we,” “us,” or “our”), operates the Pathwaize software platform, Pathwaize Intelligence, websites, applications, communication systems, data products, artificial intelligence features, calculators, integrations, and related products and services collectively referred to as the “Services.”

This Privacy Policy applies to subscribers, authorized account users, website visitors, prospective customers, individuals who communicate through the Services, and individuals whose information may appear in Atlas, Atlas Radar, or other lead-data products.
By accessing or using the Services, you acknowledge the practices described in this Privacy Policy.
1) Who We Are and When This Policy Applies

- CRM, pipeline, lead management, reporting, workflow, and automation features;
- connected applications and integrations;
- emails, SMS messages, calls, webinars, forms, surveys, support interactions, and other communications with Pathwaize; and
- any other Pathwaize feature or service that links to this Privacy Policy.
This Privacy Policy does not govern third-party products, websites, platforms, or services that Pathwaize does not control.
2) Our Role in Processing Information
Pathwaize’s legal role depends on the context in which information is processed.
A. Pathwaize as Controller or Business
Pathwaize generally acts as a controller or business when we determine why and how personal information is processed, including for:
- account administration;
- billing;
- website analytics;
- marketing;
- security;
- Pathwaize product development;
- Atlas and Atlas Radar operations;
- Pathwaize Intelligence administration;
- privacy requests; and
- compliance activities.
B. Pathwaize as Processor or Service Provider
Pathwaize generally acts as a processor or service provider when we process Customer Data on behalf of a subscriber according to the subscriber’s instructions.
In those circumstances, the subscriber generally determines:
- which information is collected;
- which individuals are contacted;
- which workflows are activated;
- how the information is used;
- how long the information should be retained; and
- whether the subscriber has the required notices, permissions, and consents.
If we receive a privacy request concerning information that we process solely on behalf of a subscriber, we may direct the request to that subscriber or assist the subscriber in responding.
3) Key Definitions
Customer Data
“Customer Data” means information a subscriber or authorized user uploads, enters, imports, connects, stores, generates, or processes through the Services.
Customer Data may include:
- CRM contacts;
- lead and seller information;
- buyer and tenant information;
- call recordings and transcripts;
- emails and SMS messages;
- pipeline and opportunity information;
- property and deal information;
- notes, tasks, files, and documents;
- scripts, templates, and workflows;
- team activity;
- marketing information;
- financial and performance data; and
- other business information.
Customer Content
“Customer Content” means Customer Data together with documents, communications, prompts, instructions, media, knowledge, materials, and other content provided to or generated through the Services.
Intelligence Data
“Intelligence Data” means information processed by Pathwaize Intelligence or its related features, including:
- implementation surveys and intake responses;
- business descriptions and operating information;
- company, founder, and brand information;
- products, services, offers, pricing, and positioning;
- customer profiles and target markets;
- business strategies and operating processes;
- scripts, FAQs, objections, and responses;
- SOPs, policies, and training materials;
- documents, presentations, recordings, and transcripts;
- websites, social profiles, and existing content;
- CRM, pipeline, lead, communication, and transaction information;
- marketing and attribution information;
- KPIs, performance metrics, growth rates, conversion data, and financial or operational measurements;
- prompts, instructions, preferences, corrections, and feedback;
- AI-generated outputs, insights, analyses, and recommendations;
- AI Engine actions, approval decisions, execution history, and audit logs; and
- structured information stored in a Business Knowledgebase.
Business Knowledgebase
“Business Knowledgebase” means the organized collection of business information, documents, context, terminology, rules, preferences, processes, examples, and other Intelligence Data used to personalize Pathwaize Intelligence and its AI Engines.
Inputs
“Inputs” means prompts, instructions, questions, documents, data, communications, files, feedback, or other information submitted to an AI feature.
AI Outputs
“AI Outputs” means content, recommendations, summaries, analyses, projections, classifications, drafts, scores, suggested actions, or other material generated through an AI feature.
Atlas/Radar Lead Data
“Atlas/Radar Lead Data” means property, owner, contact, and enrichment data made available through Atlas or Atlas Radar.
It may include:
- names;
- mailing and property addresses;
- phone numbers;
- email addresses;
- property characteristics;
- ownership information;
- mortgage and equity information;
- valuation information;
- listing information;
- occupancy indicators;
- public-record information;
- distress or motivation indicators;
- demographic or geographic information where legally available; and
- related data points.
Purchased Data
“Purchased Data” means Atlas/Radar Lead Data that is delivered, unlocked, exported, purchased, saved, or otherwise made available to a subscriber through Atlas or Atlas Radar.
Personal Information
“Personal information” and “personal data” mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an identified or identifiable individual, as defined by applicable law.
4) Subscriber Responsibilities for Customer Data
If you upload, import, connect, store, or process information about leads, sellers, buyers, tenants, clients, employees, contractors, vendors, or other individuals, you are responsible for ensuring that you have:
- a lawful basis for collecting and using the information;
- provided required privacy notices;
- obtained any required permissions or consents;
- authority to provide the information to Pathwaize and our service providers;
- authority to record, transcribe, analyze, or store communications;
- authority to use the information for automated workflows or AI processing; and
- complied with applicable opt-out, suppression, and do-not-contact requests.
You may not use the Services to collect or process information unlawfully.
5) Categories of Information We Collect
We collect information directly from users, automatically through the Services, from connected services, from service providers, and from third-party or publicly available sources.
A. Identification and Contact Information
We may collect:
- name;
- email address;
- phone number;
- mailing address;
- company name;
- job title or company role;
- account identifiers; and
- related contact information.
B. Account and Authentication Information
We may collect:
- username;
- encrypted or hashed credentials;
- account settings;
- permissions and user roles;
- authentication records;
- subscription level;
- account status;
- support history; and
- implementation and onboarding information.
C. Billing and Transaction Information
We may collect:
- subscription plan;
- payment and billing status;
- invoices and receipts;
- usage-based charges;
- credits and wallet balances;
- lead-purchase activity;
- AI usage;
- communication usage;
- payment method type;
- transaction identifiers; and
- limited payment information received from payment processors.
Payment card information is generally processed by third-party payment processors. Pathwaize does not store complete payment card numbers on its own servers.
D. Communications and Customer Content
We may collect and process:

- SMS and chat messages;

- phone calls and voicemails;
- call recordings;
- Voice AI interactions;
- transcripts and summaries;
- contact and lead notes;
- message timestamps;

E. CRM, Lead, and Deal-Flow Information
We may collect:
- lead-source information;
- lead status;
- pipeline stage;
- contact attempts;

- contracts;
- deal outcomes;
- acquisition and disposition data;
- property details;
- motivation indicators;
- team activity;
- task completion;
- sales activity; and
- associated performance metrics.
F. Device, Usage, and Technical Information
We may automatically collect:
- IP address;
- browser type;
- device identifiers;
- operating system;
- screen size;
- language and time-zone settings;
- login activity;
- pages or features used;
- clicks and navigation activity;
- referring and exit pages;
- session activity;
- timestamps;
- error logs;
- diagnostic information;
- platform-performance information; and

G. Location Information
We may infer approximate location from an IP address.
We do not intentionally collect precise GPS location unless a feature specifically requires it, the collection is disclosed, and any legally required permission is obtained.
H. Cookies and Tracking Technologies

- SDKs;
- local storage;
- analytics tags;
- beacons;
- session-replay technology, if used; and
- similar technologies.
I. Atlas and Atlas Radar Information
When you use Atlas or Atlas Radar, we may collect and store:

- property criteria;
- motivation criteria;
- saved searches;
- Radar monitoring rules;
- lists and leads pulled;
- Purchased Data;
- saved or exported records;
- tags and notes;
- lead and property statuses;
- delivery records;
- notification history;
- list-hygiene events;
- subscription and billing events;
- credit usage; and
- support and troubleshooting information.
J. Deal Analyzer Information
When you use Deal Analyzer calculators or similar tools, we may collect and store:
- property information;
- purchase price;
- estimated value or ARV;
- repair or construction budgets;
- rent assumptions;
- operating expenses;
- financing information;
- interest rates;
- holding costs;
- sale assumptions;
- projected profits;
- projected returns;
- cash-flow projections;
- saved scenarios;
- deal notes; and
- related AI or calculator outputs.
K. Pathwaize Intelligence Information
When you use Pathwaize Intelligence, we may collect and process:
- Intelligence Data;
- Business Knowledgebase information;
- implementation and onboarding responses;
- uploaded source materials;
- business, founder, and brand preferences;
- operational data;
- CRM and communication data;
- KPI and performance data;
- marketing and attribution data;
- connected-service information;
- Inputs;
- AI Outputs;
- inferred insights;
- corrections and feedback;
- approval or rejection decisions;
- content-generation history;
- workflow and AI Engine activity;
- execution records;
- model, prompt, and feature-performance information; and
- audit and system logs.
L. Connected Account and Integration Information
If you connect a third-party service to Pathwaize, we may receive information authorized by that connection, such as:
- account identifiers;
- access or refresh tokens;
- files and documents;
- email or calendar information;
- CRM records;
- website content;
- social-media content;
- analytics information;
- advertising information;
- contacts;
- communications; and
- other information supported by the integration.
You may be able to revoke an integration through Pathwaize or the connected provider. Revoking access does not necessarily delete information previously imported or generated through the connection.
M. Sensitive Personal Information
Customer Data, calls, transcripts, deal notes, or Intelligence Data may incidentally contain sensitive personal information, such as:
- health-related information;
- financial-hardship information;
- government identifiers;
- account information;
- precise location;
- immigration or citizenship information;
- racial or ethnic information;
- religious information; or
- other legally protected information.
Do not upload or collect sensitive information unless it is reasonably necessary for a legitimate purpose, you have the legal right to process it, and you have obtained any required consent.
Pathwaize may process sensitive information contained in Customer Data according to subscriber instructions and as needed to provide the Services.
N. Children’s Information
The Services are intended for individuals who are at least 18 years old.
We do not knowingly collect personal information directly from children under 13. We do not knowingly sell or share a minor’s personal information or use it for targeted advertising where applicable law requires prior consent.
6) Sources of Information
We may collect information from:
- you;
- subscribers and authorized account users;
- individuals who communicate through the Services;
- your team members or representatives;
- your use of the Services;
- connected applications and integrations;
- implementation surveys;
- uploaded files and documents;
- websites and social profiles you identify or authorize us to review;
- payment processors;
- analytics and advertising providers;
- telecom, email, SMS, and messaging providers;
- cloud and infrastructure providers;
- third-party AI and large-language-model providers;
- property, owner, contact, and enrichment-data providers;
- public records;
- publicly available sources;
- business partners;
- service providers; and
- other lawful sources.
7) How We Use Information
We may use personal information to:
- provide, operate, maintain, and secure the Services;
- create, administer, authenticate, and support accounts;
- provide Pathwaize Intelligence and its AI Engines;
- create and maintain Business Knowledgebases;
- analyze business, CRM, communication, marketing, and performance information;
- generate Intel Briefs and other reports;
- generate AI Outputs;
- personalize AI Outputs to a subscriber’s business;
- provide Atlas and Atlas Radar;
- deliver and store Purchased Data;
- provide Voice AI and conversational AI;
- create call recordings, transcripts, summaries, and follow-up actions;
- provide Deal Analyzer calculators and projections;
- enable searching, filtering, deduping, tagging, scoring, routing, reporting, and automation;
- create, recommend, queue, schedule, transmit, or publish content according to subscriber settings;
- process orders, subscriptions, lead purchases, usage-based charges, and payments;
- provide onboarding, implementation, and support;
- troubleshoot errors and performance issues;
- send billing, account, security, operational, and service communications;
- send marketing communications as permitted by law;
- personalize features and recommendations;
- analyze usage and product performance;
- evaluate, test, train, tune, and improve Pathwaize systems;
- detect and prevent fraud, abuse, spam, unlawful activity, and security incidents;
- enforce our Terms of Service and other agreements;
- comply with legal and regulatory obligations;
- establish, exercise, or defend legal claims;
- protect Pathwaize, subscribers, individuals, and the public; and
- perform another purpose disclosed when information is collected or permitted by law.
8) Pathwaize Intelligence
Pathwaize Intelligence analyzes information across a subscriber’s business, generates tactical insights, maintains structured business context, and powers specialized AI Engines that may generate or execute work.
A. Business Knowledgebase Processing
Pathwaize Intelligence may organize Customer Content and Intelligence Data into a Business Knowledgebase.
The Business Knowledgebase may be used to:
- preserve company and founder context;
- maintain consistent terminology;
- document products, services, markets, and offers;
- preserve brand and communication preferences;
- organize FAQs, objections, scripts, and processes;
- generate more relevant AI Outputs;
- reduce the need to repeatedly brief AI features;
- support multiple AI Engines with shared context; and
- improve consistency across Pathwaize features.
B. Operational Intelligence and Inferences
Pathwaize Intelligence may analyze:
- leads;
- calls;
- messages;
- response times;
- appointments;
- pipeline movement;
- follow-up activity;
- stalled opportunities;
- conversion indicators;
- team activity;
- marketing performance;
- deal performance;
- revenue or profit information;
- content performance; and
- other operational information.
From this information, Pathwaize Intelligence may derive:
- trends;
- summaries;
- classifications;
- scores;
- forecasts;
- recommendations;
- identified risks;
- potential opportunities;
- suggested priorities;
- inferred business insights; and
- proposed actions.
These outputs are generated using automated methods and may be incomplete or inaccurate.
C. AI Inputs and Outputs
Inputs submitted to Pathwaize Intelligence may be processed to generate AI Outputs.
AI Outputs may include:
- summaries;
- recommendations;
- operational analyses;
- business insights;
- reports;
- marketing content;
- social-media content;
- articles;
- newsletters;
- scripts;
- emails;
- workflow recommendations;
- deal analyses;
- classifications;
- lead scores;
- suggested follow-up;
- drafts; and
- other generated material.
AI Outputs may reflect information contained in the subscriber’s Business Knowledgebase and other Intelligence Data.
D. Specialized AI Engines
Pathwaize Intelligence may use specialized AI Engines to perform tasks such as:
- analyzing operational activity;
- identifying important changes;
- generating tactical recommendations;
- structuring business knowledge;
- creating authority and marketing content;
- creating social and publishing materials;
- analyzing deals;
- preparing or recommending offers;
- supporting migration or data organization;
- recommending follow-up;
- generating website or funnel content; and
- carrying out other subscriber-configured workflows.
Available functionality may vary by plan, configuration, implementation stage, model provider, and product version.
E. Connected Platforms and Publication
When authorized by a subscriber, an AI Engine may:
- create content;
- save content to Pathwaize;
- transmit content to a connected service;
- queue content for review;
- schedule content;
- publish content;
- update records;
- initiate workflows; or
- take another configured action.
Information transmitted to a connected service becomes subject to that service’s privacy policy and terms.
F. Human Review and Subscriber Approval
Some Pathwaize Intelligence workflows may require subscriber review or approval before an action is executed.
Other workflows may execute automatically based on:
- subscriber settings;
- approved rules;
- configured permissions;
- workflow conditions; or
- instructions previously provided by the subscriber.
Subscribers are responsible for:
- selecting appropriate permissions;
- reviewing AI Outputs;
- verifying important information;
- approving high-impact actions;
- supervising authorized users; and
- determining whether an output or action is suitable for their business.
Pathwaize may retain approval records, changes, execution history, and audit logs for support, security, compliance, and product improvement.
9) Third-Party AI and Model Providers
Pathwaize may use third-party:
- large-language models;
- generative AI providers;
- speech-to-text providers;
- text-to-speech providers;
- image-generation providers;
- data-processing providers;
- search or retrieval systems;
- machine-learning services; and
- AI infrastructure providers.
Information sent to these providers may include:
- Inputs;
- Customer Content;
- Intelligence Data;
- Business Knowledgebase excerpts;
- call audio;
- transcripts;
- prompts;
- instructions;
- relevant CRM or performance data; and
- other information needed to provide the requested feature.
We seek to limit information sent to third-party providers to information reasonably necessary for the relevant function.
Third-party providers may retain or process information for limited periods for service delivery, security, abuse prevention, reliability, support, or other purposes permitted under their applicable agreements.
Different Pathwaize plans, configurations, AI Engines, or features may use different providers. Those providers may have different technical, retention, and data-processing practices.
Pathwaize may add, remove, or replace providers as the Services develop.
10) Learning, Training, Evaluation, and Service Improvement
As described in our Terms of Service, Pathwaize may use Customer Content and Intelligence Data to:
- operate and support the Services;
- secure the Services;
- diagnose errors;
- evaluate feature performance;
- test prompts and workflows;
- evaluate AI Outputs;
- develop quality and safety controls;
- train, tune, or improve Pathwaize-specific features;
- improve AI Engines and retrieval systems;
- improve scoring, classification, and recommendation systems;
- develop or improve proprietary datasets, prompts, workflows, evaluations, and safeguards; and
- develop new Pathwaize products and functionality.
This processing may include Inputs, AI Outputs, corrections, feedback, usage patterns, approval decisions, and interaction history.
Where reasonably practicable for generalized product improvement, we may use data that has been:
- aggregated;
- de-identified;
- pseudonymized;
- redacted; or
- otherwise limited.
Authorized Pathwaize personnel and contractors may review Customer Content or Intelligence Data when reasonably necessary for:
- implementation;
- support;
- security;
- troubleshooting;
- quality assurance;
- evaluation;
- product development; or
- compliance.
Such access is limited according to role and business need and is subject to confidentiality and security obligations.
We do not sell Customer Content or Intelligence Data to unrelated third parties for their own independent marketing purposes.
11) Voice AI, Calls, Recordings, and Transcripts
If you use Voice AI, call answering, calling, voicemail, transcription, SMS, email, or related features, we may process:
- call audio;
- recordings;
- transcripts;
- summaries;
- phone numbers;
- names;
- messages;
- timestamps;
- call duration;
- call disposition;
- seller and property information;
- appointment information;
- detected conversation topics;
- follow-up instructions; and
- related metadata.
We may use this information to:
- answer and route calls;
- generate transcripts and summaries;
- qualify leads;
- schedule appointments;
- update CRM records;
- automate follow-up;
- analyze conversations;
- identify business or lead insights;
- improve system performance;
- provide support;
- maintain compliance records; and
- document interactions.
We provide or facilitate call-recording notices where required by the configured service. Subscribers remain responsible for determining which notices and consents are legally required for their use.
12) Atlas and Atlas Radar
A. Atlas
Atlas allows subscribers to search, filter, unlock, and retrieve property, owner, and contact information.
Atlas may involve per-lead, per-record, per-pull, credit-based, or usage-based charges.
B. Atlas Radar
Atlas Radar allows subscribers to establish monitoring criteria and automatically receive property, owner, and contact information when records match those criteria or when relevant information changes.
Atlas Radar may involve:
- recurring subscription charges;
- per-lead charges;
- per-record charges;
- credit usage; or
- other usage-based charges.
C. Storage of Purchased Data
We may store Purchased Data in a subscriber’s account so the subscriber can:
- access it later;
- avoid duplicate purchases;
- maintain lists;
- route leads;
- use workflows;
- track lead activity;
- connect records with CRM activity;
- receive property updates;
- analyze performance; and
- use other Pathwaize features.
D. Data Sources and Accuracy
Atlas/Radar Lead Data may come from:
- public records;
- public sources;
- third-party data providers;
- property databases;
- contact and enrichment providers;
- licensed data sources; and
- derived or inferred information.
Atlas/Radar Lead Data may be inaccurate, incomplete, delayed, or outdated. Pathwaize does not guarantee that every record is complete or correct.
Subscribers are responsible for independently verifying information before relying on it or contacting an individual.
E. No Customer-Specific Data Sharing
We do not provide one subscriber’s:
- saved searches;
- pulled lists;
- notes;
- tags;
- CRM activity;
- communications;
- account-specific workflows; or
- account-specific Purchased Data activity
to another subscriber.
The same underlying property, owner, public-record, or third-party-sourced record may independently be available to more than one subscriber.
F. Restrictions on Use
Atlas/Radar Lead Data is not represented as a consumer report.
Subscribers may not use Atlas/Radar Lead Data to determine eligibility for:
- consumer credit;
- employment;
- tenant screening;
- insurance;
- government benefits;
- education; or
- another purpose governed by the Fair Credit Reporting Act or similar eligibility laws.
13) Deal Analyzer and Financial Projections
Deal Analyzer and related calculators may process property, financing, expense, revenue, and investment assumptions to generate projections.
Projections and AI Outputs are estimates based on:
- information entered by the user;
- assumptions selected by the user;
- third-party information;
- available market or property information; and
- automated calculations.
Deal Analyzer outputs are not legal, tax, financial, accounting, lending, appraisal, investment, or underwriting advice.
Subscribers should independently verify information and consult qualified professionals before making financial or investment decisions.
14) De-Identified and Aggregated Information
We may create de-identified or aggregated information from information processed through the Services.
We may use that information for:
- analytics;
- benchmarking;
- research;
- product development;
- security;
- performance measurement;
- business planning;
- training and evaluation;
- statistical reporting;
- product demonstrations; and
- other lawful purposes.
When we maintain information as de-identified data, we will take reasonable measures designed to:
- prevent the information from being associated with an individual;
- maintain and use it in de-identified form;
- avoid attempting to reidentify the information, except where permitted to test the effectiveness of de-identification; and
- require recipients to maintain the information in de-identified form where required by law.
15) Examples, Demonstrations, and Case Studies
To explain the Services and demonstrate results, Pathwaize may use de-identified, redacted, or aggregated information derived from subscriber use.
Examples may include:
- Voice AI calls;
- call transcripts or excerpts;
- AI conversations;
- deal-flow activity;
- lead-response times;
- missed-call information;
- follow-up activity;
- appointment activity;
- conversion rates;
- pipeline metrics;
- deal outcomes;
- operational improvements;
- content-performance information;
- growth rates; and
- other business-performance metrics.
We may use this information in:
- product demonstrations;
- training materials;
- sales materials;
- website content;
- emails;
- social-media content;
- presentations;
- webinars;
- customer examples; and
- case studies.
Before external use, we will redact or remove information that could reasonably identify:
- the subscriber;
- the subscriber’s company;
- an account user;
- a contact or lead;
- a phone number;
- an email address;
- a property;
- a property address;
- a parcel identifier;
- a transaction;
- a confidential business record; or
- another unique identifier.
We will not identify a subscriber or subscriber company by name without express permission.
Subscribers may opt out by emailing contact@pathwaize.com with the subject line “Case Study Opt-Out.”
An opt-out will apply to future use. We will also make reasonable efforts to remove or replace previously published material where reasonably practicable.
16) How We Disclose Information
We disclose information as described below.
A. Service Providers and Processors
We may disclose information to vendors that provide:
- cloud hosting;
- infrastructure;
- databases;
- security;
- authentication;
- analytics;
- payment processing;
- customer support;
- CRM and automation technology;
- monitoring and logging;
- telecom services;
- SMS and email delivery;
- call routing;
- transcription;
- AI and machine-learning services;
- data storage;
- integration services;
- professional services; and
- legal or compliance support.
These providers may process information only as permitted by their agreements, our instructions, and applicable law.
B. AI and Model Providers
We may disclose information to third-party AI and model providers as described in Section 9.
C. Atlas and Atlas Radar Providers
We may disclose information to data sources, enrichment providers, validation providers, fulfillment vendors, and infrastructure providers as reasonably necessary to:
- obtain records;
- validate records;

D. Connected Services
When a subscriber connects or directs Pathwaize to interact with another service, we may disclose information to that service as necessary to carry out the subscriber’s instruction.
E. Analytics and Advertising Providers
We may disclose limited website, browser, device, cookie, and interaction information to analytics or advertising providers for:
- measuring website performance;
- understanding product usage;
- measuring campaigns;
- improving advertising;
- retargeting; or
- delivering interest-based advertising.
Where this activity is considered targeted advertising, sharing, or sale under applicable law, you may opt out.
F. Professional Advisors
We may disclose information to lawyers, accountants, auditors, insurers, consultants, and other advisors where reasonably necessary for their services.

Pathwaize does not sell subscriber Customer Data or Intelligence Data to unrelated third parties for their own independent marketing purposes.
However, two types of activity may fall within broad state-law definitions of “sale” or “sharing.”
A. Atlas and Atlas Radar
Atlas and Atlas Radar provide property, owner, and contact information to business subscribers.
Some state privacy laws may classify the transfer of this third-party-sourced data for monetary or other valuable consideration as a sale of personal data.
Categories of information that may be transferred through Atlas or Atlas Radar include:
- identifiers;
- contact information;
- property information;
- ownership information;
- commercial information;
- public-record information;
- geographic information;
- inferred property or motivation indicators; and
- related enrichment information.
Categories of recipients may include:
- real estate investors;
- real estate investment businesses;
- authorized business subscribers; and
- service providers supporting subscriber-requested delivery.
B. Website Advertising and Analytics
Some disclosures of cookie, device, browser, or website-activity information to advertising partners may be considered:
- targeted advertising;
- cross-context behavioral advertising;
- sharing; or
- sale
under applicable state law.

- carry out subscriber-configured actions.
Pathwaize is designed to support business operations and human decision-making.
Pathwaize is not intended to make final eligibility decisions concerning:
- credit;
- employment;
- housing eligibility;
- tenant screening;
- insurance;
- education;
- government benefits;
- healthcare; or
- access to essential services.
Subscribers may not use the Services to make legally significant eligibility decisions where doing so would violate applicable law.
Where applicable law grants a right to opt out of qualifying profiling or automated decision-making, you may submit a request as described below.
20) Your Privacy Rights
Depending on where you reside and which laws apply, you may have the right to:
- confirm whether we process your personal information;
- access personal information we process;
- obtain specific pieces of personal information;

Do not send highly sensitive identity documents unless we specifically request them through an appropriate process.
We may request additional information to verify your identity or authority.
Where permitted, you may use an authorized agent. We may require proof that the agent is authorized to act for you and may verify your identity directly.
We generally respond within 45 days after receiving a verified request. Where permitted, we may extend that period by an additional 45 days and will notify you of the extension.

- subscribers who previously exported the data; or
- other entities that independently control the information.
However, we will make reasonable efforts to suppress verified information from future Atlas/Radar outputs where technically feasible and legally required.
Suppression may not remove information that a subscriber exported, downloaded, saved, or used before the request was processed.

Marketing Emails
You may unsubscribe using the unsubscribe link in a marketing email.
SMS Messages
You may opt out of SMS marketing by replying STOP. Reply HELP for assistance. Standard message and data rates may apply.
Targeted Advertising and Sale/Share Opt-Out
You may opt out where applicable by:
- enabling Global Privacy Control or another legally recognized preference signal;

25) Subscriber Responsibilities for Communications and Outreach
Subscribers are responsible for complying with laws and industry requirements applicable to communications initiated through the Services, including:
- the Telephone Consumer Protection Act;
- the Telemarketing Sales Rule;
- the National Do Not Call Registry;
- state telemarketing and do-not-call laws;
- call-recording and wiretapping laws;
- CAN-SPAM;
- consent requirements;
- opt-out and revocation requirements;
- quiet-hour restrictions;
- carrier requirements;
- messaging-platform rules; and
- other laws applicable to the subscriber’s business and outreach.
Pathwaize does not guarantee that a phone number, email address, lead, property owner, or other individual may lawfully be contacted.
Subscribers are responsible for:
- screening contacts;
- obtaining required consent;
- maintaining suppression lists;
- honoring opt-outs;
- applying appropriate quiet hours;
- verifying time zones;
- reviewing AI-generated communications; and
- maintaining required records.
26) Data Retention
We retain personal information for as long as reasonably necessary for:
- the purposes described in this Privacy Policy;
- providing the Services;
- maintaining active accounts;
- security;
- fraud prevention;
- legal compliance;
- dispute resolution;
- enforcing agreements;
- maintaining business and financial records;
- supporting privacy requests; and
- other legitimate business purposes.
Retention depends on:
- the type of information;
- the subscriber’s settings;
- the duration of the account;
- contractual requirements;
- provider limitations;
- legal obligations;
- security needs;
- whether information is contained in backups; and
- whether information is subject to a dispute, investigation, suppression request, or legal hold.
A. Customer Data
We generally retain Customer Data while an account remains active and for a reasonable period after account termination, subject to deletion settings, legal requirements, backups, and our agreements.
B. Intelligence Data and Business Knowledgebases
We may retain Intelligence Data, Business Knowledgebase information, AI Outputs, prompts, feedback, execution records, and related logs while an Intelligence subscription or Pathwaize account remains active and afterward as reasonably necessary for:
- account restoration;
- support;
- security;
- auditability;
- service improvement;
- legal compliance; and
- enforcement of our agreements.
C. Atlas/Radar Purchased Data
We may retain Purchased Data in a subscriber’s account to provide:
- continued access;
- deduplication;
- list management;
- reporting;
- automation;
- billing support;
- suppression;
- compliance; and
- related features.
Purchased Data may be deleted or restricted when:
- a subscriber deletes it;
- an account is closed;
- retention is restricted by a provider;
- deletion is required by law;
- a verified suppression request applies; or
- retention is no longer reasonably necessary.
D. AI Provider Retention
Third-party AI and infrastructure providers may retain information for periods established by their applicable service configurations, contracts, security processes, or legal requirements.
E. De-Identified Information
We may retain de-identified and aggregated information for longer periods where permitted by law.
27) Data Security
We maintain administrative, technical, and physical safeguards designed to protect information.
Safeguards may include:
- access controls;
- role-based permissions;
- authentication;
- encryption in transit;
- logging;
- monitoring;
- backups;
- vendor reviews;
- confidentiality obligations;
- incident-response procedures; and
- other reasonable security controls.
No service or method of transmission or storage is completely secure. We cannot guarantee absolute security.
If a security incident requires notification, we will provide notice as required by applicable law.
28) Third-Party Links, Services, and Integrations
The Services may link to or integrate with third-party products and services.
Third parties may collect and process information according to their own privacy policies and terms.
Pathwaize is not responsible for the privacy or security practices of third parties that we do not control.
Review the privacy policies and settings of connected services before authorizing access.
29) International Users
Pathwaize operates from the United States.
If you access the Services from outside the United States, information may be transferred to and processed in the United States and other countries where Pathwaize or its providers operate.
Those jurisdictions may have privacy laws that differ from the laws in your location.
The Services are primarily intended for use in the United States unless Pathwaize expressly agrees otherwise.
30) Changes to This Privacy Policy
We may update this Privacy Policy as our products, providers, legal obligations, and data practices change.
The “Last Updated” date identifies the latest revision.
If we make material changes, we may provide additional notice through:
- the Services;
- account notifications;
- email;
- our website; or
- another appropriate method.
If we materially expand how previously collected Customer Content or Intelligence Data is used for AI training, model development, or another materially different purpose, we will provide additional notice and obtain consent where required by law.
Continued use of the Services after an updated policy becomes effective constitutes acknowledgment of the revised policy.
